These Terms of Use (the “Terms”), entered into by and between you and Hera Society (“Hera,” “we,” “us,” or “our”), govern your access to and use of the (1) website (“Website”) located at herasociety.com; (2) mobile application (“App”); and (3) any services, content, and features made available by, on, or through the Website or the App (collectively, the “Services”), and any information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively, the “Content”) operated and provided by Mt Olympus, LLC and on which these Terms appear. These Terms are a legal and binding agreement between you and Hera.

By signing up for, or otherwise accessing or using, our Services, you agree to these Terms. If you do not agree to these Terms, then you must not use our Services or access any Content.

Use of our Services is subject to the Privacy Policy and additional terms and conditions presented by Hera, all of which are made part of these Terms by reference.

  1. Acceptance of These Terms Please read these Terms carefully before you start to use our Services. By using our Services, you represent and warrant that you are legally able to enter into this Agreement. By accessing or using our Services, completing the Hera account registration process, or by clicking, tapping, or taking similar action to signify you affirmatively accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, incorporated herein by reference. Your access and use of our Services are subject at all times to these Terms and our Privacy Policy.

If you do not agree to these Terms or cannot comply, do not access or use our Services. These Terms apply to all visitors, users, and others who wish to access or use our Services.

  1. Who Can Use the Services / Account Eligibility Our Services are not directed to children under the age of thirteen (13). By using our Services, you represent and warrant that you are 13 years or older (or the minimum age at which a person may use the Services in your state province, or country without parental consent, if greater). If we have actual knowledge that you are under the age of 13 (or the minimum age at which a person may use the Services in your state province, or country without parental consent, if greater), we will cease providing Services to you and delete your account and your data. We may offer additional Services with additional terms that may require you to be even older to use them. So please read all such terms carefully.

By using our Services you represent, warrant, and agree that:

You are at least 13 years old and over the minimum age required by the laws of your country of residence to access and use the Services; You are legally qualified to enter a binding contract with Hera, or if you are over 13 but under the age of majority in your jurisdiction, that your legal guardian has reviewed and agrees to these Terms; You are seeking information about a person whom you have a meaningful relationship or personal connection; You are not prohibited or barred from using the Services under the laws of the United States or any other applicable jurisdiction; You will comply with these Terms (including any other terms and policies referenced in these Terms, and all applicable local, state, national, and international laws, rules, and regulations; and You have not previously been permanently suspended or removed from our Services by us or our affiliates, unless you have our express written permission to create a new account. If at any time you cease to meet these requirements, all authorization to access our Services or systems is automatically revoked, and you must immediately delete your account, and we retain the right to remove your access to our Services without warning. 3. User Account To use certain Services, you may be required to register for an account. You must provide accurate, current, and complete information during the registration process and at all other times when you use the Services, and to update the information to keep it accurate, current, and complete. You are the sole authorized User of any account you create through the Services. You are solely and fully responsible for all activities that occur under your account. You agree that you shall monitor your account to prevent use by minors, and you will accept full responsibility for any unauthorized use of your account. You may not authorize others to use your User account, and you may not assign or otherwise transfer your User account to any other person or entity. Should you suspect that any unauthorized party may be using your account, you will notify Hera immediately. Hera will not be liable, and you may be liable for losses, damages, liability, expenses, and fees incurred by Hera or a third party arising from someone else using your account. If you provide any information that is untrue, inaccurate, not current, or incomplete, or if Hera has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Hera has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof). We may enable or require you to use a single set of login credentials to use our Services. You agree not to create an account or use the Services if you have been previously removed from Hera or if you have been previously banned from use of the Services. 4. Rules and Prohibitions Without limiting the other rules and prohibitions in these Terms, by using the Services, you agree that you will: Only use the Services for lawful purposes and you will not use or attempt to use the Services for sending or storing any unlawful material or for deceptive or fraudulent purposes. Only use the Services in accordance with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements, or other rights of any third party, including privacy, personality, or publicity rights. Only use or access the Services using means explicitly authorized by Hera. If applicable, it is your responsibility to ensure you download the correct Technology for your device. We are not liable if you do not have a compatible device or if you have downloaded the wrong version of the Technology for your device. We reserve the right to terminate your use of the Technology and/or Services if you are using the Technology or Services with an incompatible or unauthorized device. Use your real phone number in registering for Hera. The information you provide to us when you register an account or otherwise communicate with us is accurate, you will promptly notify us of any changes to such information, and you will provide us with whatever proof of identity we may reasonably request. Use the Services only for your own use and will not directly or indirectly resell, license, or transfer the Technology, Services, or content displayed through the Services to a third party. Your participation in using the Services must be for your sole, personal use. Report any errors, bugs, unauthorized access methodologies, or any breach of our intellectual property rights that you uncover in your use of the Services.

Without limiting the other rules and prohibitions in these Terms, by using the Services, you agree that you will not: Engage in conduct that harms, attempts to harm, or threatens the safety of other Users, Hera, Hera employees, or our community in any way whatsoever. Engage in threatening, harassing, racist, or sexist behavior or any other behavior that Hera deems inappropriate when using the Services.
Use or attempt to use or gain unauthorized access to any part of the Services in any manner that could damage, disable, overburden, or impair (i) the Services or interfere with any other party’s use of the Services or (ii) any Hera server or the networks connected to any Hera server. Probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures Hera may use to prevent or restrict access to the Services or use of the Services or the content therein, and you will not attempt any of the foregoing. Deep-link to our Website or access our Website manually or with any robot, spider, web crawler, extraction software, automated process, and/or device to scrape, copy, index, frame, or monitor any portion of our Website or any content on our Website, and you will not attempt any of the foregoing. Reverse engineer, duplicate, decompile, disassemble, or decode the Services (including any underlying idea or algorithm), or otherwise extract the source code of the Service. Use any robot, spider, crawler, scraper, or other automated means or interface to access the Services or extract other Users’ information. Attack the Services via a denial-of-service attack or a distributed denial-of-service attack. Use or attempt to use another User’s account, impersonate any person or entity (including, without limitation, by using phone numbers or email addresses associated with any of the foregoing), or forge or manipulate headers or identifiers to disguise the origin of any content transmitted through the Services. Use or attempt to use the Services to cause nuisance, annoyance, or inconvenience. Act in an unlawful way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the United States or other countries). Misrepresent your identity, your age, or your affiliations with a person. Disclose information that you do not have the consent to disclose. Stalk or harass any other User of the Services. Create or operate a pyramid scheme, fraud, or other similar practice. Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

We do not tolerate users misbehaving and disrupting our Services. You can report any abuse or complaint about a user by contacting us, outlining the abuse and/or complaint. You can report a user by contacting [email protected].

In the event that we believe or determine that you have breached any of the aforementioned or any other provision of these Terms, we reserve the right to suspend and/or permanently deactivate your account at our sole discretion. Where required by law, we will provide you with written notice of the suspension or deactivation of your account, including the reasons which led us to take such action.

You may use the Services only for lawful purposes and in accordance with these Terms. If your access or use of the Services is prohibited by applicable law, then you are not authorized to access or use the Services. We are not responsible if you access or use the Services in any manner that violates applicable law.

We do not control any of the things our users say or do, so you are solely responsible for your interactions with other users off the Website and App.

HERA DOES NOT INQUIRE INTO THE BACKGROUNDS OF ITS USERS OR ATTEMPT TO VERIFY THE STATEMENTS OF ITS USERS. HERA MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF ANY USERS OR THEIR RELATIONSHIP STATUS OR AFFILIATIONS WITH OTHERS. You agree to, and hereby do, release Hera Society and its successors from any claims, demands, losses, damages, rights, and actions of any kind, including personal injuries, death and property damage, that either directly or indirectly arises from your interactions with or conduct of other users of the Website and/or App. If you are a California resident, you hereby waive California Civil Code Section 1542, which states, “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” The foregoing release does not apply to any claims, demands, or any losses, damages, rights and actions of any kind, including personal injuries, death or property damage for any unconscionable commercial practice by Hera Society or for such party’s fraud, deception, false, promise, misrepresentation or concealment, suppression or omission of any material fact in connection with the Website and/or App. 5. Termination and Suspension You can delete your account at any time by contacting us at [email protected] and submitting a request. Hera reserves the right to investigate and, if appropriate, suspend or terminate your account if Hera believes that you have violated these Terms, misused our Services, or behaved in a way that Hera regards as inappropriate or unlawful, on or off our Services. We reserve the right to make use of any personal, technological, legal, or other means available to enforce the Terms, at any time without liability and without the obligation to give you prior notice, including, but not limited to, preventing you from accessing the Services. If your account is terminated by you or by Hera for any reason, these Terms continue and remain enforceable between you and Hera, and you will not be entitled to any refund for purchases made. Your information will be maintained and deleted in accordance with our Privacy Policy. 6. Data Charges and Mobile Phones / Communications with Hera By creating a Hera account or using the Services, you agree to: (a) accept and receive communications from or on behalf of Hera providing services to you or Hera, including via email, text message, direct message, chat, and calls, to the contact information you provide to Hera when registering an account or using the Services; and (b) receive communications via push notification or in-app messages in the App.

Message and data rates may apply and message frequency may vary. You are responsible for any mobile charges that you may incur for using our Services. The communications in this Section 6 may include, without limitation, commercial or marketing messages, transactional or relationship messages (e.g., messages about the availability of our Services (e.g., interruptions in Services), security and/or fraud (e.g., verification messages), safety, responses to communications initiated by you, updates to policies/legal agreements (e.g., privacy policies, terms of service), newsletters, and messages relating to research, political advocacy, or customer support (those initiated by you and by us). You acknowledge that receiving commercial or marketing messages is not a requirement or condition for you to use the Services. For purposes of clarity, any message (including text message) or call you may receive from us regarding an inquiry is a transactional message, not a commercial, marketing, or promotional message or call. If there are changes to your contact information (e.g., email address, phone number), you agree to update your account to help prevent or limit Hera inadvertently communicating with someone else.

By providing us with your mobile phone number you agree, among other things, to receive communications from Hera related to the Services, including about promotions (where we have consent or as permitted by law), your account, and your relationship with Hera. You agree that these communications may be received even if your phone number is registered on any state or federal Do Not Call list, or international equivalent.

The opt-out options for communications are set out below. If you opt out of receiving communications via one channel, that opt out will only apply to the specific channel for which the opt out is submitted (e.g., if you opt out of receiving email communications, it will not apply to any other channels through which communications can be sent). Please see the following for more information: For email communications that permit opting out (e.g., commercial/marketing messages), there is an opt-out mechanism in the messages. For transactional or relationship email messages, the only opt-out option is to delete your account. To opt out of receiving transactional or relationship text messages (e.g., inquiry updates), you can reply “STOP” to a text message you receive. To opt out of all communications, the only option is to delete your account. You authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to Hera or its service provider for the duration of your business relationship, solely to help them identify you or your wireless device and to prevent fraud. See our Privacy Policy for how we treat personal information. 7. Rights You Are Granted By Hera Hera grants you the right to use and enjoy our Services, subject to these Terms. For as long as you comply with these Terms, Hera grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use our Services for purposes as intended by Hera and permitted by these Terms and applicable laws. This license and any authorization to access the Services are automatically revoked in the event that you fail to comply with these Terms. 8. Intellectual Property Any text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, images, and other intellectual property appearing on our Services is owned, controlled, or licensed by us and protected by copyright, trademark, and other intellectual property law rights. All rights, title, and interest in and to our Content remains with us at all times. 9. Paid Services There are no fees for use of many aspects of the Services. However, some services, features, and products may be available for purchase (“Paid Services”). 10. Misconduct and Reporting Hera does not tolerate inappropriate behavior on or off of the Services. We encourage you to report any misconduct by other Users. You can report a User by emailing [email protected]. As set forth in our Privacy Policy, we may share data between our affiliates for the safety and security of our Users and may take necessary actions if we believe you have violated these Terms, including banning you from our Services and/or our affiliates’ services, and/or preventing you from creating new accounts. You understand and agree that we may not share information with you regarding your account if doing so would potentially impair the safety or privacy of our other users. 11. Privacy Hera’s Privacy Policy explains how and why we collect, use, and share information about you when you access or use our Services. By using our Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms, and consent to the collection and use of information about you as set forth in the Privacy Policy. 12. Indemnity Except to the extent prohibited by law, you agree to defend, indemnify, and hold Hera, its affiliates, and their respective directors, officers, employees, agents, contractors, third-party service providers, and licensors harmless from and against any claim or demand made by any third party, and any related liability, damage, loss, and expense (including costs and attorneys’ fees) due to, arising out of, or in connection with: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of applicable laws or regulations. We reserve the right to control the defense of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. 13. Disclaimers and Limitation of Liability THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE EXTENT PERMITTED BY APPLICABLE LAW, WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. HERA DOES NOT REPRESENT OR WARRANT THAT (A) YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; (C) ANY DEFECTS OR ERRORS IN OUR SERVICES WILL BE DISCOVERED OR CORRECTED; OR (D) THAT ANY INFORMATION YOU OBTAIN ON OR THROUGH OUR SERVICES WILL BE ACCURATE, RELIABLE, OR APPROPRIATE FOR YOUR PURPOSES. HERA DOES NOT CONTROL, ENDORSE, OR TAKE RESPONSIBILITY FOR THE ACTIONS OF ANY THIRD PARTY OR USER. FURTHERMORE, HERA MAKES NO GUARANTEES AS TO THE NUMBER OF ACTIVE USERS AT ANY TIME; USERS’ ABILITY OR DESIRE TO COMMUNICATE WITH OR MEET YOU, OR THE ULTIMATE CONDUCT OF USERS YOU COMMUNICATE THROUGH OR BEYOND THE SERVICES. HERA DISCLAIMS AND ASSUMES NO RESPONSIBILITY FOR ANY CONDUCT OF YOU OR ANY OTHER USER, ON OR OFF OUR SERVICES. HERA ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER USER OR THIRD PARTY SENDS OR RECEIVES THROUGH OUR SERVICES; NOR DOES HERA ASSUME RESPONSIBILITY FOR THE IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF ANY USERS WITH WHOM YOU MAY COMMUNICATE WITH THROUGH HERA. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF OUR SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK. HERA IS NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER HARDWARE, COMPUTER SOFTWARE, OR OTHER EQUIPMENT OR TECHNOLOGY INCLUDING, BUT WITHOUT LIMITATION, DAMAGE FROM ANY SECURITY BREACH OR FROM ANY VIRUS, BUGS, TAMPERING, HACKING, FRAUD, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER LINE OR NETWORK FAILURE, OR ANY OTHER TECHNICAL OR OTHER DISRUPTION OR MALFUNCTION.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HERA, ITS AFFILIATES, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; OR (II) THE CONDUCT OF ANY USERS OR THIRD PARTIES ON OR THROUGH ANY OF OUR AFFILIATES’ SERVICES OR IN CONNECTION WITH THE SERVICES. IN NO EVENT WILL THE AGGREGATE LIABILITY OF HERA EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR ANY AMOUNT YOU PAID HERA IN THE PREVIOUS SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SECTION WILL APPLY TO ANY THEORY OF LIABILITY, INCLUDING THOSE BASED ON WARRANTY, CONTRACT, STATUTE, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF HERA HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF ANY REMEDY SET FORTH IN THESE TERMS IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the exclusions and limitations in this section may not apply to you. Instead, in such jurisdictions, the exclusions and limitations above shall apply only to the extent permitted by the laws of such jurisdictions. 14. To the fullest extent permitted by applicable law, any claims arising out of or relating to these Terms or the Services will be governed by the laws of the State of Delaware, without regard to its conflict of laws rules; all disputes related to these Terms or the Services will be brought solely in the federal or state courts located in the State of Delaware, and you and Hera consent to personal jurisdiction in these courts. 15. Third-Party Services Our Services may contain advertisements and promotions offered by third parties and links to other websites or resources. Hera may also provide non-commercial links or references to third parties within its content. Hera is not responsible for the availability (or lack of availability) of any external websites or resources or their content. The applicable third party’s terms will govern their relationship with you. Furthermore, Hera is not responsible for, and does not endorse, any products or services that may be offered by third-party websites or resources. If you choose to interact with the third parties made available through our Services, such party’s terms will govern their relationship with you. Hera is not responsible or liable for such third parties’ terms or actions. 16. Modifying the Services and These Terms We may add or remove features, products, or functionalities as we improve our Services, and we may also suspend or stop the Services altogether. We may take any of these actions at any time for any reason, and when we do, we may not provide you with any notice beforehand.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of our Services thereafter. We will use commercially reasonable efforts to generally notify all users of any material changes to these Terms, such as through a notice on Hera, however, you should look at the Terms regularly to check for such changes. We will also update the “Last Updated” date at the top of these Terms, which reflect the effective date of such Terms. Your continued access or use of the Services following the posting of revised Terms constitutes your acceptance and agreement to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
If you do not agree to the new Terms, you must stop accessing or using the Services. 17. Entire Agreement These Terms, with the Privacy Policy, contain the entire agreement between you and Hera regarding the use of our Services. The Terms supersede all previous agreements, representations, and arrangements between us, written or oral. If any provision of these Terms is held invalid, illegal, or otherwise unenforceable, the remainder of the Terms shall continue in full force and effect. The failure of Hera to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You agree that your Hera account is non-transferable and all of your rights to your account and its content terminate upon your death, unless otherwise provided by law. Any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction. No agency, partnership, joint venture, fiduciary or other special relationship or employment is created as a result of these Terms, and you may not make any representations on behalf of or bind Hera in any manner. 18.   1. About Hera and this Privacy Policy Hera Society (hereafter, “Hera,” “we,” “us,” or “our”) is committed to protecting your privacy. Hera serves to allow people to discreetly and anonymously keep tabs on a personal romantic relationship.

This Privacy Policy (“Policy”) applies to all Hera platforms, which includes the Hera mobile application (“App”) and website herasociety.com (“Website”), accessed via any platform or device that links to this Policy. The term “Services” means and collectively refers to Hera’s services offered on or through such platforms. This Policy explains how we collect, protect, use, store, and disclose the personal information of users and other individuals age thirteen (13) and over. This Policy applies to personal information relating to: (i) individuals who are registered users of or subscribers to our Services (“Users”) and (ii) individuals who are not Users but are identified by a User as a person with whom that User shares a personal connection (“Non-User”).

By using our Services or providing information to us, you consent to us collecting, storing, using, and disclosing information as described in this Policy.

Collection of Personal Information When you use our Services, we may collect information from and about you, including information that you provide to us directly and information automatically collected. 2.1.1. Information You Provide When you use our Services, you may provide information to us, including when you register with Hera, contact us with inquiries, respond to surveys, or otherwise access or use our Services. This information may include some or all of the following: Personal Information. When you use our Services, we may ask you to provide us with certain personal information that can be used to contact or identify you. Personal information includes, but is not limited to your phone number. For safety and security we require users to verify their accounts and ask for Users’ phone numbers to do so. We want to prevent robot activity and fake inquiries which can be used for malicious activities and cybercrime. This verification is required by Hera to prevent fraud. When you provide your phone number, we send different kinds of transactional text messages directly relating to your use of your Services, like verifying your phone number and alerts. Hera allows a User to associate a User’s phone number with the phone number of a person with whom the User has a personal connection (“Non-User”). We may collect and process information related to the User and the Non-User. This information includes personal information such as the phone number of the User and the phone number of the Non-User.
Clipboard. Information, including text, found in your device’s clipboard, with your permission. For example, if you choose to paste a phone number from your clipboard onto Hera, we access this information stored in your clipboard in order to fulfill your request. Payment Information. If you purchase any of Hera’s products and/or Services, you may provide your credit or debit card information. Hera uses third-party services for payment processing. Hera will not store or collect your payment card details. Payment information is provided directly to our third-party payment processors whose use of your personal information is governed by their respective privacy policies. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of payment information. Correspondence with Hera. When you use our Services, complete electronic forms, communicate with or contact us for support, we may collect and store certain information about you and the correspondence that you voluntarily provide to us, for example: contact information; the nature and content of your communication; the purpose of the interaction; and the action we took in response to your inquiry or request. For example, upon detection of a match (i.e., when two or more Hera Users associate their phone numbers with the phone number of a same Non-User), Hera may share your phone number with the other User(s), and vice versa, as you consented to in using our Services. To Law Enforcement. We may share personal information for legal, safety, and security purposes. We may share personal information if we reasonably believe that disclosing the information is needed or required to: Comply with any valid legal process, governmental request, valid request by public authorities, or applicable law, rule, or regulation; Investigate, remedy, or enforce potential Terms of Use violations; Protect the rights, property, or safety of Hera, Hera’s users, or others; and/or Detect and resolve any fraud or security concerns. To Authorized Business Partners. Authorized Business Partners are third parties whose services Hera uses to operate and improve our own Services. These third parties include agents, contractors, service providers, and other third parties that we use to support our business and who are bound by the contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. In the Event of a Business Transaction. If we are involved in a merger, acquisition, asset sale, financing, liquidation or bankruptcy or acquisition of all or some portion of our business to another company, your personal information may be transferred or shared with that company before and after that transaction closes. 3. For example, upon detection of a match (i.e., when two or more Users associate their phone numbers with the phone number of the same Non-User), Hera may enable the Users to connect outside of our Services; To facilitate and administer our communication and interaction with Users; To handle inquiries, complaints, and requests; To comply with legal and regulatory requirements; and To exercise our rights, and to defend ourselves from claims. 3.4. No Disclosure of Personal Information Hera does not disclose the personal information of Non-Users to other Users or third parties. Accordingly, no Users or third parties will receive personal information about Non-Users. 4. How We Secure, Store, and Retain Information 4.1. Security of Information Hera has implemented reasonable technical and organizational precautions to protect the confidentiality, security, and integrity of personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, no method of electronic storage is ever fully secure or error-free. While we strive to safeguard personal information, we cannot guarantee the security of information transmitted to us over the Internet. Any transmission of personal information is at your own risk. Storage of Information Your information, including personal information, may be transferred to and maintain on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside the United States and choose to provide information to us, you should be aware that once your Personal Information is submitted through our Services, it will be transferred to the United States, processed there, and therefore governed by local data protection laws, which can vary state by state.

Capitalized terms used in this Notice but not defined herein, shall have the meaning ascribed to such terms in the Privacy Policy. Our Privacy Policy and privacy controls we offer to all users are in line with these laws; however, this Notice ensures we cover state-specific requirements.

These Terms of Use (the “Terms”), entered into by and between you and Hera Society (“Hera,” “we,” “us,” or “our”), govern your access to and use of the (1) website (“Website”) located at herasociety.com; (2) mobile application (“App”); and (3) any services, content, and features made available by, on, or through the Website or the App (collectively, the “Services”), and any information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively, the “Content”) operated and provided by Mt Olympus, LLC and on which these Terms appear. These Terms are a legal and binding agreement between you and Hera.

By signing up for, or otherwise accessing or using, our Services, you agree to these Terms. If you do not agree to these Terms, then you must not use our Services or access any Content.

Use of our Services is subject to the Privacy Policy and additional terms and conditions presented by Hera, all of which are made part of these Terms by reference.

By using our Services, you represent and warrant that you are legally able to enter into this Agreement. By accessing or using our Services, completing the Hera account registration process, or by clicking, tapping, or taking similar action to signify you affirmatively accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, incorporated herein by reference. Your access and use of our Services are subject at all times to these Terms and our Privacy Policy.

If at any time you cease to meet these requirements, all authorization to access our Services or systems is automatically revoked, and you must immediately delete your account, and we retain the right to remove your access to our Services without warning. 3. User Account To use certain Services, you may be required to register for an account. We may enable or require you to use a single set of login credentials to use our Services. You agree not to create an account or use the Services if you have been previously removed from Hera or if you have been previously banned from use of the Services. 4. Rules and Prohibitions Without limiting the other rules and prohibitions in these Terms, by using the Services, you agree that you will: Only use the Services for lawful purposes and you will not use or attempt to use the Services for sending or storing any unlawful material or for deceptive or fraudulent purposes. Only use the Services in accordance with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements, or other rights of any third party, including privacy, personality, or publicity rights. Only use or access the Services using means explicitly authorized by Hera. If applicable, it is your responsibility to ensure you download the correct Technology for your device. We are not liable if you do not have a compatible device or if you have downloaded the wrong version of the Technology for your device. We reserve the right to terminate your use of the Technology and/or Services if you are using the Technology or Services with an incompatible or unauthorized device. Use your real phone number in registering for Hera. The information you provide to us when you register an account or otherwise communicate with us is accurate, you will promptly notify us of any changes to such information, and you will provide us with whatever proof of identity we may reasonably request. Use the Services only for your own use and will not directly or indirectly resell, license, or transfer the Technology, Services, or content displayed through the Services to a third party. Your participation in using the Services must be for your sole, personal use. Report any errors, bugs, unauthorized access methodologies, or any breach of our intellectual property rights that you uncover in your use of the Services.

Without limiting the other rules and prohibitions in these Terms, by using the Services, you agree that you will not: Engage in conduct that harms, attempts to harm, or threatens the safety of other Users, Hera, Hera employees, or our community in any way whatsoever. Engage in threatening, harassing, racist, or sexist behavior or any other behavior that Hera deems inappropriate when using the Services.
Use or attempt to use or gain unauthorized access to any part of the Services in any manner that could damage, disable, overburden, or impair (i) the Services or interfere with any other party’s use of the Services or (ii) any Hera server or the networks connected to any Hera server. Probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures Hera may use to prevent or restrict access to the Services or use of the Services or the content therein, and you will not attempt any of the foregoing. Deep-link to our Website or access our Website manually or with any robot, spider, web crawler, extraction software, automated process, and/or device to scrape, copy, index, frame, or monitor any portion of our Website or any content on our Website, and you will not attempt any of the foregoing. Reverse engineer, duplicate, decompile, disassemble, or decode the Services (including any underlying idea or algorithm), or otherwise extract the source code of the Service. Use any robot, spider, crawler, scraper, or other automated means or interface to access the Services or extract other Users’ information. Attack the Services via a denial-of-service attack or a distributed denial-of-service attack. Use or attempt to use the Services to cause nuisance, annoyance, or inconvenience. We do not control any of the things our users say or do, so you are solely responsible for your interactions with other users off the Website and App.

HERA DOES NOT INQUIRE INTO THE BACKGROUNDS OF ITS USERS OR ATTEMPT TO VERIFY THE STATEMENTS OF ITS USERS. HERA MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF ANY USERS OR THEIR RELATIONSHIP STATUS OR AFFILIATIONS WITH OTHERS. Hera reserves the right to investigate and, if appropriate, suspend or terminate your account if Hera believes that you have violated these Terms, misused our Services, or behaved in a way that Hera regards as inappropriate or unlawful, on or off our Services. We reserve the right to make use of any personal, technological, legal, or other means available to enforce the Terms, at any time without liability and without the obligation to give you prior notice, including, but not limited to, preventing you from accessing the Services. If your account is terminated by you or by Hera for any reason, these Terms continue and remain enforceable between you and Hera, and you will not be entitled to any refund for purchases made. Your information will be maintained and deleted in accordance with our Privacy Policy. 6. Data Charges and Mobile Phones / Communications with Hera By creating a Hera account or using the Services, you agree to: (a) accept and receive communications from or on behalf of Hera providing services to you or Hera, including via email, text message, direct message, chat, and calls, to the contact information you provide to Hera when registering an account or using the Services; and (b) receive communications via push notification or in-app messages in the App.

Message and data rates may apply and message frequency may vary. You are responsible for any mobile charges that you may incur for using our Services. The communications in this Section 6 may include, without limitation, commercial or marketing messages, transactional or relationship messages (e.g., messages about the availability of our Services (e.g., interruptions in Services), security and/or fraud (e.g., verification messages), safety, responses to communications initiated by you, updates to policies/legal agreements (e.g., privacy policies, terms of service), newsletters, and messages relating to research, political advocacy, or customer support (those initiated by you and by us). You acknowledge that receiving commercial or marketing messages is not a requirement or condition for you to use the Services. By providing us with your mobile phone number you agree, among other things, to receive communications from Hera related to the Services, including about promotions (where we have consent or as permitted by law), your account, and your relationship with Hera. You agree that these communications may be received even if your phone number is registered on any state or federal Do Not Call list, or international equivalent.

The opt-out options for communications are set out below. If you opt out of receiving communications via one channel, that opt out will only apply to the specific channel for which the opt out is submitted (e.g., if you opt out of receiving email communications, it will not apply to any other channels through which communications can be sent). Please see the following for more information: For email communications that permit opting out (e.g., commercial/marketing messages), there is an opt-out mechanism in the messages. For transactional or relationship email messages, the only opt-out option is to delete your account. To opt out of receiving transactional or relationship text messages (e.g., inquiry updates), you can reply “STOP” to a text message you receive. This license and any authorization to access the Services are automatically revoked in the event that you fail to comply with these Terms. 8. Intellectual Property Any text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, images, and other intellectual property appearing on our Services is owned, controlled, or licensed by us and protected by copyright, trademark, and other intellectual property law rights. Hera may also provide non-commercial links or references to third parties within its content. Hera is not responsible for the availability (or lack of availability) of any external websites or resources or their content. The applicable third party’s terms will govern their relationship with you. Furthermore, Hera is not responsible for, and does not endorse, any products or services that may be offered by third-party websites or resources. If you choose to interact with the third parties made available through our Services, such party’s terms will govern their relationship with you. Hera is not responsible or liable for such third parties’ terms or actions. 16. Modifying the Services and These Terms We may add or remove features, products, or functionalities as we improve our Services, and we may also suspend or stop the Services altogether. Personal information includes, but is not limited to your phone number. For safety and security we require users to verify their accounts and ask for Users’ phone numbers to do so. We want to prevent robot activity and fake inquiries which can be used for malicious activities and cybercrime. This verification is required by Hera to prevent fraud. When you provide your phone number, we send different kinds of transactional text messages directly relating to your use of your Services, like verifying your phone number and alerts. By providing your mobile phone number, you expressly consent to receive these types of transactional text messages from us at that number. Third-party data and message fees may apply. If your phone number changes, please ensure that you update this; Information Related to a Non-User. Hera allows a User to associate a User’s phone number with the phone number of a person with whom the User has a personal connection (“Non-User”). We may collect and process information related to the User and the Non-User. This information includes personal information such as the phone number of the User and the phone number of the Non-User.
Clipboard. Information, including text, found in your device’s clipboard, with your permission. For example, if you choose to paste a phone number from your clipboard onto Hera, we access this information stored in your clipboard in order to fulfill your request. Payment Information. If you purchase any of Hera’s products and/or Services, you may provide your credit or debit card information. Hera uses third-party services for payment processing. Hera will not store or collect your payment card details. Payment information is provided directly to our third-party payment processors whose use of your personal information is governed by their respective privacy policies. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express, and Discover. For example, upon detection of a match (i.e., when two or more Hera Users associate their phone numbers with the phone number of a same Non-User), Hera may share your phone number with the other User(s), and vice versa, as you consented to in using our Services. To Law Enforcement. We may share personal information for legal, safety, and security purposes. We may share personal information if we reasonably believe that disclosing the information is needed or required to: Comply with any valid legal process, governmental request, valid request by public authorities, or applicable law, rule, or regulation; Investigate, remedy, or enforce potential Terms of Use violations; Protect the rights, property, or safety of Hera, Hera’s users, or others; and/or Detect and resolve any fraud or security concerns. To Authorized Business Partners. Authorized Business Partners are third parties whose services Hera uses to operate and improve our own Services. These third parties include agents, contractors, service providers, and other third parties that we use to support our business and who are bound by the contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. In the Event of a Business Transaction. If we are involved in a merger, acquisition, asset sale, financing, liquidation or bankruptcy or acquisition of all or some portion of our business to another company, your personal information may be transferred or shared with that company before and after that transaction closes. 3. Non-Users In connection with our Services, we may collect limited information about Non-Users, which can occur when a User associates the User’s phone number with the phone number of a Non-User. We do not sell or share (as these terms are defined under applicable data protection and privacy laws) the personal information, such as phone numbers, of Non-Users. We do not disclose the personal information, such as phone numbers, of Non-Users. 3.1. Personal Information Collected When a User uses our Services, we may collect and process personal information about Non-Users, such as the phone number of the Non-User. 3.2. Source of Personal Information When a User uses our Services, we may receive the personal information of Non-Users described in this Policy from other Users. Specifically, we may receive the phone number of a Non-User from one or more Users, such as when a User associates the User’s phone number with the Non-User’s phone number. 3.3. Purposes or Uses of Personal Information When a User uses our Services, we may collect and process personal information about Non-Users for some or all of the following purposes or uses: To connect two or more Users. For example, upon detection of a match (i.e., when two or more Users associate their phone numbers with the phone number of the same Non-User), Hera may enable the Users to connect outside of our Services; To facilitate and administer our communication and interaction with Users; To handle inquiries, complaints, and requests; To comply with legal and regulatory requirements; and To exercise our rights, and to defend ourselves from claims. 3.4. No Disclosure of Personal Information Hera does not disclose the personal information of Non-Users to other Users or third parties. Accordingly, no Users or third parties will receive personal information about Non-Users. 4. How We Secure, Store, and Retain Information 4.1. Security of Information Hera has implemented reasonable technical and organizational precautions to protect the confidentiality, security, and integrity of personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, no method of electronic storage is ever fully secure or error-free. While we strive to safeguard personal information, we cannot guarantee the security of information transmitted to us over the Internet. Any transmission of personal information is at your own risk. Storage of Information Your information, including personal information, may be transferred to and maintain on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside the United States and choose to provide information to us, you should be aware that once your Personal Information is submitted through our Services, it will be transferred to the United States, processed there, and therefore governed by local data protection laws, which can vary state by state.
4.3. Retention of Information We will retain information only for as long as is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by law. We will retain and use your personal information to the extent necessary to comply with our legal obligations (e.g., if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. 5. The term profiling has specific definitions under state laws and typically means automated processing to analyze an individual’s economic, situation, health, personal preferences, interests, reliability, behavior, location, or movements in a way that would produce a legal or similarly significant effect. User or Non-User: Hera does not engage in this type of profiling of individuals. Right to Limit the Use and Disclosure of Sensitive Personal Information Under the CPRA, this right provides an individual with the opportunity to direct a business that collects sensitive personal information about the individual to limit its use of the individual’s sensitive personal information to only the use necessary to perform the services or provide the goods reasonably expected by the average individual who requests those services or goods or as otherwise permitted under applicable data protection and privacy laws. This right is limited to sensitive personal information used for the purpose of inferring characteristics about an individual. User or Non-User: Hera does not use sensitive personal information for the purpose of inferring characteristics about an individual, therefore we do not offer a path to exercise this right. Please note that certain sections of this Notice reference back to the Privacy Policy (such as detailed information on how to exercise privacy rights). Capitalized terms used in this Notice but not defined herein, shall have the meaning ascribed to such terms in the Privacy Policy. Users in California, Nevada, Virginia, Colorado, and Connecticut have certain privacy rights as specified under state law. Our Privacy Policy and privacy controls we offer to all users are in line with these laws; however, this Notice ensures we cover state-specific requirements.

We mainly use these to offer our Services, for example to create your account and detect matches.
